Bayou to Beltway: October 10, 2018

This week Bayou to Beltway talks with Dr. Thomas Aiello who has written an important book on the issue of non-unanimous juries in Louisiana.

Dr. Aiello's book, Jim Crow's Last Stand: Non Unanimous Criminal Jury Verdicts in Louisiana, has improbably set in motion of chain of events culminating in Constitution Amendment 2, on the November 6, 2018 ballot. If passed, this Amendment would eliminate non-unanimous juries in Louisiana, which is almost alone among the states in allowing life sentences without benefit of unanimous juries. Dr. Aiello and I talk about this issue and about its implications for defendants and their families, and criminal justice in Louisiana. We explore the tangled roots of this odd exception to the unanimous standard in American juris prudence, and weigh the considerations that may lead to its undoing in our era.
